1. Who this agreement is with
This agreement is between you and Visional Media Limited, company number 04247285, registered office 30 Orange Street, London WC2H 7HF.
It covers your use of xpanded.com as a cam host or phone chat host.
Our Terms & Conditions, Acceptable Use Policy and Privacy Policy also apply to you.
2. Your status
You are an independent self-employed contractor. You are not our employee, worker or agent.
This means:
- you decide when you work, for how long, and whether to work at all;
- you decide what you are willing to do within the limits of our Acceptable Use Policy;
- you can work for other platforms;
- you are responsible for your own tax and National Insurance, and for registering with HMRC;
- you do not receive holiday pay, sick pay, pension contributions or notice.
3. Before you can go live
You must provide, and we must verify:
- government-issued photo ID showing you are 18 or over
- a second form of identity confirmation
- a live selfie or verification video matching your ID
- signed consent to appear in content on the platform
- your legal name, address and date of birth
- bank or payout details
Anyone else appearing in your content must complete the same verification and sign a separate consent before appearing. This includes partners, friends and anyone visible in the background. This is a payment card scheme requirement and we cannot make exceptions.
We keep verification records for as long as your content is on the platform, as required by our payment providers.
You must tell us immediately if anyone appearing in your content withdraws consent.
4. What you can and cannot do
Everything in the Acceptable Use Policy applies to you, with the additional host rules in section 3 of that policy.
In short: everyone on screen or on the call is verified and consenting, nothing on the prohibited list, no offline arrangements, no off-platform payments, no broadcasting while intoxicated.
5. Your content and what we can do with it
You own your content. We do not.
You grant us a non-exclusive, worldwide, royalty-free licence to host, store, display, transmit and stream your content on xpanded.com only, for as long as you keep it on the platform.
That licence is limited to operating this platform. It does not let us:
- publish your content on any other website, including co-branded, white-label or affiliate sites;
- licence, sell or syndicate your content to anyone;
- allow search engines to index your content;
- use your content or image in advertising or marketing;
- keep using your content after you remove it or leave.
If we want to do any of those things, we will ask you separately, tell you exactly where the content will appear, and you can say no. Consent to one channel is not consent to another, and you can withdraw it.
5.1 Recorded content
If you allow recordings of your shows to be sold:
- you choose whether to enable this;
- you can withdraw a recording from sale at any time;
- users who already bought it keep access, but it will not be sold again;
- revenue share is as in section 6.
5.2 Taking your content down
You can remove your content at any time. We will take it down and remove it from our systems within 30 days, other than backups and anything we must keep for a legal obligation or open investigation.
If you leave the platform, all your content comes down.
7. Your privacy and safety
- We do not disclose your legal name, address or contact details to users.
- You can block individual users.
- You can restrict access from named countries or regions.
- You can end any session at any time, for any reason, and you do not have to explain.
- If a user harasses or threatens you, report it and we will act. Persistent or serious cases result in permanent account closure and, where appropriate, a report to the police.
- Recording your streams is prohibited for users, and we will pursue anyone who does it.
If someone shares your content off-platform without permission, tell us and we will help with takedown requests where we reasonably can.
8. Ending this agreement
You can leave at any time, with no notice. Your content comes down and we pay you what you have earned at the next payout date.
We may suspend or end your account if you seriously or repeatedly breach this agreement or the Acceptable Use Policy, if we are required to by law or a payment provider, or if we stop operating.
Except where we suspect a criminal offence or the law prevents us, we will tell you why and give you a chance to respond first.
If we end your account, you still get paid for what you have already earned, unless those earnings are directly connected to fraud.
We will give reasonable notice if we stop operating the platform.
9. Appeals
If you disagree with a decision — content removed, payment held, account suspended — you can appeal through the process in our Complaints, Reporting and Takedown Policy. We aim to decide appeals within a reasonable period.
10. Liability
We are responsible for losses we cause you by breaking this agreement or failing to use reasonable care and skill.
We do not exclude liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.
We are not liable for the actions of users, for loss of expected earnings, or for interruptions to the Services outside our reasonable control.
11. General
We may update these terms on 30 days' notice. If you do not accept a change, you can leave and take your final payment.
This agreement is governed by the law of England and Wales.
If you are based in the EU, you keep the benefit of any mandatory protections of your own country's law, and you may bring proceedings where you live.
